This appeal is from the judgment of the lower court dismissing an application of appellant for writ of mandate against respondents, members of the Board of Prison Terms and Paroles, together with the warden of the Washington state penitentiary. Respondents demurred to the petition on the ground that the same did not state facts sufficient to constitute a cause of action or to justify any relief. An order was entered sustaining the demurrer, and appellant, having refused to plead further, a judgment of dismissal was entered.
